According to Mark Powell, spokesperson for the state’s attorney general, the Berkeley County grand jury indicted Amy Kovach, the school district’s communications director, Tuesday afternoon.
Powell confirmed that Kovach was indicted on one count of violating the ethics act by allegedly abusing public funds to influence the outcome of an election.
The offense is a misdemeanor punishable by up to a fine of $5,000 or up to one year in prison, Powell stated.
Powell did not state whether more indictments would follow.
Kovach began working for the Berkeley County School District in 2011 after spending several years working for MeadWestvaco in their communications department.
The current charge stems from the district’s 2012 “Yes 4 Schools” campaign and whether district leaders worked during district time and utilized district resources to see to it that voters approved a referendum to build new schools and renovate several others.
Voters did ultimately say ‘yes’ to the 198 million dollar referendum, in turn, paving the way for five new schools and renovations to more than 20 others.
Superintendent Rodney Thompson and Deputy Superintendent Archie Franchini were previous targets of an in depth investigation regarding the “Yes” campaign as well.
Attorney General Alan Wilson has stressed that all defendants are presumed innocent until proven guilty in a court of law.
The investigation remains ongoing.
