Judge denies request to dismiss ethics charge against BCSD communications director

BERKELEY COUNTY, S.C.—According to The Post & Courier, a circuit court judge has rejected a request to dismiss an ethics charge against Amy Kovach.

Kovach is the communications director for the Berkeley County School District who remains on leave ever since a grand jury indicted her on multiple charges earlier this year.

Her attorney, Jerry Theos, made a motion late last month to have the charge that claims Kovach used public funds to influence the outcome of an election during the ‘Yes 4 Schools’ campaign thrown out.

In a report by WCBD-TV, Theos told Circuit Judge Roger Young that the law Kovach is accused of violating does not apply here because this was a bond measure, not an election. He added that even if it did apply, she was only informing the public, which is her duty.

Judge Roger Young saw things differently.

He ruled Monday that a bond referendum like Berkeley County’s 2012 ‘Yes 4 Schools’ does fall under the definition of election. He also stated that the term “governmental entity” includes employees.

Kovach is also charged with forgery.
